A few miles away in unincorporated Port Charlotte, the seawall is entirely the homeowner's responsibility. Same canals, same 1960s construction, completely different answer to "whose wall is this?"

Only preserve status also removes DEP's free online self-certification and brings the seagrass clearance rule with it. The distinction decides how you apply, not just how big you can build.

That is designated aquatic preserve water, so both of those apply here. Inside an aquatic preserve, a dock has to reach water deep enough to leave at least one foot of clearance between the top of the seagrass and the lowest point of the moored boat. On a shallow, grassy bay that is what sets the length of the dock — the seagrass, not the boat. It is the most common reason a dock has to be longer than an owner expected, and the most common reason a short dock fails review.

The Coastal Construction Control Line at Boca Grande
