Every aquatic preserve is an Outstanding Florida Water, but not every Outstanding Florida Water is an aquatic preserve. Both drop the dock exemption to 500 square feet. Only preserve status also removes DEP's free online self-certification and brings the seagrass clearance rule with it. The distinction decides how you apply, not just how big you can build.

Next door, and under different rules: Gasparilla Sound-Charlotte Harbor Aquatic Preserve at the river mouth. If your frontage is anywhere near that line, it is worth establishing which side of it you are on before a design is drawn.

These boundaries follow the water, not the city limits, so two neighbors can sit on different sides of one. We confirm the status for your specific parcel before anything is designed — it is the single most common thing we correct when an owner tells us what they believe they are allowed to build.
